Death Penalty for Musharraf In Treason Case

The special court has announced its case verdict, in which the former president Pervez Musharraf has been given the death penalty for the act of treason.

Pakistan’s former president Pervez Musharraf has been given the death sentence by a three member bench of the Supreme Court led by the Peshawar High Court Chief Justice Waqar Ahmed Seth. It was a narrow 2-1 verdict in which it was decided that he would be given the death penalty for treason. The case against Musharraf has been going on since he was charged with treason in 2013.

History of the case:

He was charged with treason for the imposition of a state of emergency on November 3, 2007, as well as suspending the constitution and arresting several judges who were protesting the illegal ousting of then Supreme Court Chief Justice Iftikhar Muhammad Chaudhry.

In 2014, Musharraf was indicted and a case against him was presented before the special court later that year. However, as a result of litigation at appellate forums, the case was delayed. Musharraf had then left for Dubai in 2016.

The special court had claimed that it would have announced the verdict that it had reserved on the 19th of November, on the 28th of November. However, the current ruling government filed an application in the Islamabad High Court in which it requested that the announcement be postponed until a new prosecution team is appointed. On the 5th of December, the special court had announced that the verdict will be announced on the 17th of December.

Reactions:

Journalist Hamid Mir claims that the verdict would help prevent any form of military interference in Pakistani politics for good. He also notes that the former PML-N government took a great initiative in launching the case against him. He also claims that the current PTI government had tried its best to prevent the verdict from being announced.

Legal expert Irfan Qadir believes that the decision of the case was wrong. He believes that the case was not legally sound since the judges who were overhearing the case were appointed illegally to their position. He claims the verdict to be biased.
