Chemical Castration of Rapists Officially Approved
In addition to the already approved Anti-Rape Ordinance 2020, President Dr Arif Alvi on Tuesday confirmed the approval of chemical castration of rapists.
Earlier on Tuesday, November 24, the federal cabinet approved the Anti-Rape (Investigation and Trial) Ordinance, 2020, and the Pakistan Penal Code (Amendment) Ordinance, 2020. As of today, December 16, President Dr Arif Alvi has announced that in addition to the approved acts, chemical castration of those convicted of rape has been made official.
The consent of the convict will not be required for carrying out chemical castration, instead, it will be the disposition of the judge of the trial court. This, however, is contrary to the approved draft by the Cabinet Committee on Legislative Cases (CCLC).
Earlier when chemical castration was not approved, Prime Minister Imran Khan was adamant on making it official and including it in the Anti-Rape Ordinance to counter the increasing incidents of rape.
Initially, the cabinet (CCLC) introduced chemical castration mainly as a form of rehabilitation and was subject to consent (international law makes it mandatory to take consent of the convict before the said procedure), however, now it will be based on the discretion of the judge of the trial court.
According to a statement issued by the President House on Tuesday, special courts will be set up throughout the country for speedy trial of sexual assault suspects. These courts will have to wrap up the cases within four months. Repeated offenders would undergo chemical castration under the guidance of a notified board, the statement added. Moreover, under the approved ordinance, the prime minister’s anti-rape crisis cells would be set up for conducting medico-legal examination within six hours of the incident.
